1. About HousingPulse

HousingPulse ("we", "us", "our") is a property intelligence service that aggregates and presents publicly available New York City government data to help renters, buyers, and housing professionals research properties. HousingPulse is not affiliated with any government agency.

2. Acceptance of Terms

By accessing or using the HousingPulse website, mobile application, or any related services (collectively, the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 13 years old to use HousingPulse. By using the Service you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. Your Account

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@housingpulse.app if you suspect unauthorized access.
• You may not share your account or transfer it to another person.

5. Permitted Use

You may use HousingPulse for personal, non-commercial research and for legitimate professional housing-related purposes. You agree not to:

• Scrape, crawl, or systematically download data from the Service in bulk
• Use the Service to build a competing product or service
• Reverse-engineer any part of the Service
• Attempt to gain unauthorized access to our systems
• Use the Service for any unlawful purpose
• Harass, intimidate, or harm any person using information from the Service

6. Data Accuracy Disclaimer

HousingPulse displays data sourced from NYC Open Data and related city APIs. While we strive to present accurate, up-to-date information, we make no warranties as to the completeness, accuracy, or timeliness of any data displayed.

You should independently verify any information before making housing, financial, or legal decisions. HousingPulse is an informational tool — it is not a substitute for professional legal, financial, or real estate advice.

7. Subscription & Payments

Some features require a paid subscription ("Pro"). By subscribing:

• You authorize us to charge your payment method on a recurring basis.
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• Refunds are handled in accordance with Apple App Store or Google Play policies for in-app purchases.
• We reserve the right to change subscription pricing with at least 30 days' notice.

8. Intellectual Property

The HousingPulse name, logo, design, software, and original content are owned by us and protected by copyright, trademark, and other laws. The underlying NYC government data remains in the public domain per applicable open-data licenses.

You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSINGPULSE AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING RELIANCE ON DATA DISPLAYED THEREIN.

11. Indemnification

You agree to indemnify and hold harmless HousingPulse from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may close your account at any time by emailing support@housingpulse.app. Termination does not entitle you to a refund of any prepaid fees except as required by applicable law.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice in the app at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
